Former information permanent secretary Sam Phiri who was arrested yesterday this morning appeared before Principal Magistrate Aridah Chulu.
However, plea failed to take place in the matter because the defence lawyers contended that the indictment is defective.
Dr. Phiri is charged with two counts of abuse of authority of office contrary to section 99(1) of the penal code cap 87 of the laws of Zambia and corruption acquisition of public property and revenue contrary to section 33(1) (2) (b) (3) of the Anti Corruption Act no 38 of 2010 of the laws of Zambia.
This is a case in which Phiri is jointly charged with former Zambia Daily Mail deputy Managing Director Davis Mataka and Ngande Mwanajiti a consultant for abuse of office of authority.
The defence team led by Major Lisitu of Central Chambers submitted to the court that the first count be quashed on grounds of duplicity.
He said the count contains a number of offences and that the accused must be clear on the offences they should defend themselves.
The prosecution team led by senior legal and prosecution officer from the Anti Corruption commission Silumesi Mudula could not respond to the preliminary issues raised by the defence team and asked for more time.
The matter comes up for plea on January 18 at 14:00 hours.
