The Lusaka High Court has declined an application by former Access Financial (AFS) directors Aaron Chungu and Faustin Kabwe who wanted to re-open an old case after stumbling on new evidence.
The three judges that heard the case – Jane Kabuka, Nigel Mutuna and Evans Hamaundu – refused to re-open a case because of weak arguments.
In making the ruling on the preliminary application, Judge Kabuka said Chungu and Kabwe did not indicate the new evidence they intended to produce in court and therefore, could not grant on that basis.
Chungu, Kabwe, former finance permanent secretary Stella Chibanda and former finance minister Dr Katele Kalumba have appealed against their five year jail sentence by the Lusaka magistrates’ court for corrupt activities.
The ruling for the appeal is scheduled for next month.
