Samfya Man Gets 8 Months for Drug Trafficking

The Samfya Magistrates Subordinate Court province has convicted a 20 year old man to eight months imprisonment with hard labour for trafficking in psychotropic substances.

Before Magistrate Fabian Likulunga was Mwila Kapota of Kabanga Village in Chief Kasomabangweulu’s chiefdom in Samfya District in Luapula Province.

Kapota was charged with trafficking in psychotropic substances contrary to section 6 of the narcotic drugs act, chapter 96 of the laws of Zambia.

Facts before the Court were that Kapota on 19th May 2018 did traffic in psychotropic substance namely 5. 28 grams of marijuana an herbal product of cannabis delta nine without lawful authority.

In mitigation Kapota pleaded for lenience saying he is an orphan and that he was remorseful for the act.

In passing judgment, Magistrate Likulunga said he was lenient on the accused by sentencing him to 8 months imprisonment with hard labour when the offence in question carries the maximum of 10 to 25 years for the first offender.
