This is in a matter Charles Kalombo, 44, of House Number 54 A Kapele Street, Chingola is charged with one count of producing and circulating obscene materials contrary to section 177(1) (a) cap 87 of the Laws of Zambia.
Particulars of the offence are that, Kalombo between 1st October, 2018 to 4th October, 2018 did produce and circulate obscene material with intent to corrupt public morals.
When the matter came up before Chingola Magistrate Peggy Banda, the state through prosecutor Catherine Mubita applied that the indictment be amended.
She submitted that, Kalombo be charged with two counts of one, producing obscene cinematography film and in Count two, circulation of the same obscene cinematography film with intent to corrupt public morals contrary to the laws of Zambia.
In her ruling, Magistrate Banda advised the state to prepare a fresh indictment within 30 days and allow for commencement of trial in the matter.
She has since adjourned the matter to 30th November, 2018 for approval of indictment and possibly commencement of trial.
Magistrate Banda has since extended bail for the accused church elder.
