Tembo had sued the Attorney General in the Constitutional Court seeking a declaration that President Edgar Lungu violated the constitution by accepting the Eswatini land as a gift without declaring it to the state.
But Tembo has since decided to withdraw the matter and when it came up before the Constitutional Court Justice Mungeni Mulenga it was adjourned to January 14, 2019.
The hearing comes barely a month after Tembo filed a notice to discontinue the case to pave way for on on-going negotiations on the national dialogue process.
According to a notice to discontinue the proceedings filed in the Constitutional Court Registry, Tembo said he withdrew to pave way for the national dialogue and reconciliation after the progress which had been made so far.
Tembo had lost an application in which he wanted the court to compel state witnesses to testify in this case.
Once the subpoena was dismissed Tembo opted to apply have the matter withdrawn.
