This is in a matter the couple is charged with a count of assault occasioning bodily harm contrary to the Laws of Zambia.
Particulars of the offence are that Banjamin Chabala, 38, and his wife Agness Kaluba, 34, on December 2, 2018 and their two children aged 15 and 16, assaulted Carol Mwango, thereby occasioning bodily harm on her.
When the matter came up for judgment, magistrate Maureen Nkonde sentenced Chabala to five months simple imprisonment while Kaluba got three months simple imprisonment .
Magistrate Nkonde stated that the prosecution had proved the case beyond reasonable doubt and convicted the couple accordingly.
State prosecutor Changa Chumba applied that the two juveniles be discharged for they were not unruly and were school going children.
And in Mitigation, both Chabala and Kaluba pleaded for leniency stating that they were parents who feared that being sent to prison would make their family suffer.
However, magistrate Nkonde stated that the couple followed the victim to her house and sentenced Chabala to five months while Kaluba was jailed three months simple imprisonment.
