Lusaka principal resident magistrate David Simusamba has refused to recuse himself from handling a case where NDC president Chishimba Kambwili is charged with forgery, uttering a false document and giving false information to a public officer in relation to the registration of Mwamona Engineering Technical Services.
Mr. Kambwili had in this case applied that magistrate Simusamba recuses himself as he feared that his rights
under Article 18 of the Constitution will be breached because of the magistrate’s allegations that the former chief government spokesperson attempted to bribe him so that he passes judgment in his favour.
However, in a ruling, magistrate Simusamba has refused to recuse himself. He has also refused to refer the case to a different magistrate on circumstances created by Mr. Kambwili, calling the request as vexatious.
Magistrate Simusamba said he could only have recused himself had there been a pre-condition for him to do so, however, in this matter, there was no reason to compel him to do so.
He has set June 11 as the date for Mr. Kambwili to open his defence after he was found with a case to answer last year in November.
